Reconceiving Quebec鈥檚 Legal Responses to Surrogacy Agreements

Abstract

In June 2015, the government-appointed Comit茅 consultatif sur le droit de la famille released a report proposing substantial revisions to Quebec鈥檚 laws on surrogate motherhood. It recommended that article 541 CCQ 鈥 which renders surrogacy agreements 鈥渁bsolutely null鈥 鈥 be repealed, and that lawmakers amend the Civil Code of Qu茅bec to recognize and regulate surrogacy arrangements within the province. This paper examines the Comit茅鈥檚 proposed reforms and considers whether they better support Quebeckers鈥 reproductive choices than Quebec鈥檚 current regime. It argues that while the Comit茅鈥檚 recommendations better protect surrogate mothers鈥 interests, they do not go far enough to recognize and balance the experiences of intending mothers or to support diverse family forms. It suggests that Quebec might learn from British Columbia鈥檚 Family Law Act in reimagining its legal responses to surrogacy agreements.
